THE VISION
Heartwood Cohousing and Phase 2 will be 2 parts of a single
community. Both Heartwood Cohousing and Phase 2 will be populated
with folks who long for a deep sense of community and belonging to
the land. We will revere and steward the land. The difference will be
that us cohousing folks will live in a much more intimate community
setting designed and built according to the cohousing model.
LAND PURCHASE
HC will pay Mac $260,000 for HC's 24 lots and share of open
space.
NAME
The name of the community will be Heartwood Ranch. Our
cohousing community will be known as Heartwood Cohousing. Phase 2
will be known as the Outback portion of Heartwood Ranch. We will not
begin use of these new names until after we've gotten County
Approval.
OPEN SPACE AND COMMON FACILITIES
All open space will be shared by all Heartwood Ranch
households. The following common facilities will be constructed at
HC's expense (within 4 years of the first HC household move-in) and
will be available to all Heartwood Ranch households. HC may determine
that some subgroup within HC will construct some of these facilities,
but ultimately HC will be responsible for their construction.
All residents will be subject to rules related to how the common lands and facilities will be used. All ongoing costs related to maintenance, upkeep, taxes, etc of the common lands and facilities will be borne by all residents in an equitable manner. Some common facilities (e.g., barn & stables) will have optional participation and therefore optional allocation of ongoing costs.
It is recognized that by opening up all common lands and facilities to all households, their management will present a bigger challenge, but we also recognize that the increased sharing of resources will more than make up for that challenge. We will create covenants that specifically address conflict resolution.
Additionally, open space will be allowed to be used for the construction of a tennis court. It is not now known how the tennis court might be paid for.
COUNTY APPROVAL COSTS
HC will pay for all costs associated with obtaining County
Approval, including Brian Kimmel, engineering, legal work, and
infrastructure improvements of no real physical value. This will
specifically include all government imposed road improvements up to
the HC homes because the road up to that point would currently be
completely adequate to serve Phase 2. Road improvements beyond the HC
homes will be the responsibility of Phase 2.
OTHER INFRASTRUCTURE
If HC proposes to build water, sewer, or other systems that
could also accommodate Phase 2, HC and Phase 2 will negotiate terms
of such an arrangement when the situation arises.
PHASE 2 LOTS
Mac will retain full discretion in the creation of the 10
Phase 2 lots, however no Phase 2 lots will occupy any of the
approximately 120 acres originally planned to be the HC land. Also,
Mac will honor agreements made with the County in creating those lots
including no lots in the irrigated pastureland and the total of the
10 lots' acreage not to exceed 123 acres.
